1. Scope of this Privacy Policy

This Privacy Policy applies to personal data processed in connection with the NUDALURE website, customer accounts, purchases, delivery, customer support, returns, withdrawal requests, newsletters and other interactions with NUDALURE.

NUDALURE acts as the data controller where we determine why and how personal data is processed.

2. Personal data we may collect

Depending on how you use NUDALURE, we may process the following categories of personal data:

• identification information such as your name;
• contact information such as email address and delivery address;
• account information, login-related information and saved account preferences;
• order information including products ordered, quantities, prices, discounts and order history;
• delivery information and shipment status;
• payment and transaction information supplied or generated in connection with a payment;

• communications sent to Customer Care;

3. Why we process your data

Orders and contracts

We process the information necessary to receive your order, confirm it, take payment, fulfil it, deliver the products, communicate about the order and provide after-sales service.

The principal legal basis is the performance of a contract or taking steps at your request before entering into a contract.

Customer accounts and Favorites

If you create an account, we process account information so that you can sign in, view orders, manage addresses and use account features such as Favorites.

Payments

Payment information is processed to complete transactions, prevent payment fraud, handle refunds and maintain required financial records.

Payment card processing is performed through the payment service available at checkout. NUDALURE does not need your full payment-card number in order to provide ordinary customer support.

Delivery and fulfilment

We use the information necessary to prepare and deliver your order. Relevant information may therefore be provided to fulfilment facilities and delivery carriers.

Returns, withdrawals and legal guarantees

We process information required to administer statutory withdrawals, returns, refunds, damaged-product claims, conformity claims and other legal rights.

Customer Care

We process communications and related order information to answer questions, resolve problems and maintain an appropriate record of our correspondence.

Security and fraud prevention

We may process account, transaction, device, network and order information where reasonably necessary to protect customers, prevent fraud, secure the website, investigate misuse and establish or defend legal claims.

These activities may be based on our legitimate interests in operating a secure and trustworthy online store, provided those interests are not overridden by your rights and freedoms.

Legal and accounting obligations

Certain order, transaction, accounting and tax records are processed because NUDALURE is required to keep them under applicable law.

Analytics

Where analytics is enabled, non-essential analytics technologies are used only after the required consent has been given.

Marketing communications

Where you actively subscribe to marketing communications, we process the information needed to send those communications on the basis of your consent or another lawful basis expressly permitted by applicable law.

4. Intimate product and order information

NUDALURE sells intimate wellness products. We recognise that information about products viewed or purchased may be particularly private.

We do not ask customers to state their sexual orientation, sex life or medical condition merely in order to shop with NUDALURE.

We do not intentionally infer those characteristics from your purchases for profiling or advertising purposes.

Product-level order information is accessed and shared only where reasonably necessary for functions such as order fulfilment, Customer Care, returns, legal guarantees, fraud prevention, accounting requirements or legal claims.

5. Cookies and similar technologies

NUDALURE uses essential technologies required for functions such as security, shopping cart, checkout, customer accounts and consent preferences.

Non-essential analytics or marketing technologies require the appropriate consent before they are used where required by law.

6. Who may receive personal data

We disclose personal data only where there is a legitimate operational or legal reason to do so.

Depending on the transaction or service, recipients may include:

• website hosting, infrastructure, security and technical service providers;

• fulfilment and warehouse partners;
• delivery carriers, including the carriers used for the destination concerned;
• email and communications service providers;
• analytics providers where analytics consent has been granted;
• accountants, lawyers, insurers and other professional advisers where necessary; and
• courts, regulators, tax authorities, law-enforcement bodies or other competent authorities where disclosure is legally required or justified.

Delivery carriers ordinarily receive the information needed to deliver the parcel, such as recipient name, address and necessary contact information. They do not need a description of the intimate contents of the parcel in order to perform ordinary delivery.

7. International data transfers

Some technology or service providers may process personal data outside the European Economic Area.

Where such a transfer occurs, NUDALURE will rely on an applicable legal transfer mechanism, such as an adequacy decision, approved contractual safeguards or another mechanism permitted by data-protection law.

8. How long we keep personal data

We do not keep personal data longer than reasonably necessary for the purpose for which it was collected, subject to legal, accounting, tax, fraud-prevention and legal-claims requirements.

Retention therefore depends on the type of information.

• Order, invoice and accounting records are retained for the period required by applicable accounting and tax law.
• Customer account information is retained while the account remains active and thereafter where reasonably necessary for legal or operational purposes.
• Customer Care and claims correspondence is retained for as long as reasonably necessary to resolve the matter and protect relevant legal rights.
• Marketing subscription information is processed until consent is withdrawn or the subscription otherwise ends, subject to limited records needed to honour an unsubscribe request.

9. Your data-protection rights

Subject to the conditions provided by applicable law, you may have the right to:

• request access to your personal data;
• request correction of inaccurate data;
• request deletion of personal data;
• request restriction of processing;
• object to certain processing based on legitimate interests;
• receive certain personal data in a portable format;
• withdraw consent at any time where processing is based on consent; and
• lodge a complaint with a competent data-protection supervisory authority.

Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.

10. Supervisory authorities

Because TUVRINE COMMERCE GROUP S.R.L. is established in Romania, the Romanian National Supervisory Authority for Personal Data Processing (ANSPDCP) is a relevant supervisory authority.

Under the GDPR, you may also have the right to lodge a complaint with a competent supervisory authority in another EU Member State, including the authority in the country of your habitual residence.

For customers in Spain, the national authority is the Agencia Española de Protección de Datos (AEPD) .

For customers in Italy, the national authority is the Garante per la protezione dei dati personali .

11. Adults only

NUDALURE is an adults-only store intended for persons aged 18 years or older .

We do not knowingly offer the standard NUDALURE storefront to minors or intentionally collect personal data from persons we know to be under 18 for the purpose of selling products to them.

If we become aware that personal data has been provided by a minor in circumstances where it should not have been collected, we will take appropriate steps in accordance with applicable law.

12. Automated decision-making

NUDALURE may use automated technical or fraud-prevention signals to identify unusual transactions or security risks.

We do not currently use solely automated decision-making that produces legal effects or similarly significant effects on a customer within the meaning of applicable GDPR rules.

13. Security

We use appropriate technical and organisational measures intended to protect personal data against unauthorised access, loss, alteration, disclosure or misuse.

Access to customer information is limited according to operational need, and service providers are expected to process personal data subject to appropriate confidentiality, security and data-protection obligations.

No online system can be guaranteed to be completely immune from every security risk.
